Supplier Code of Conduct

 

EMPLOYMENT

1. Non-Discrimination

Total Packaging Solutions (T.P.S.) expects that all suppliers will not discriminate in recruitment, hiring, training and employment practices, including compensation, benefits, advancement, discipline, termination or retirement, on the basis of race, color, age, national origin, sex (including pregnancy), marital status, physical or mental disability.

2. Child Labor

T.P.S. requires that suppliers will not employ any person under the age of 16, or younger than the age for completing compulsory education in the country of manufacture where such age is higher than 16. Workers under 18 years of age should not perform work likely to jeopardise the health or safety of young persons.

3. Involuntary Labor

T.P.S. requires that suppliers will not use any forced or involuntary labor, whether prison, bonded, indentured or otherwise.

4. Coercion and Harassment

T.P.S. expects that suppliers will treat each employee with dignity and respect, and will not use corporal punishment, threats of violence or other forms of physical, sexual, psychological or verbal harassment or abuse.

5. Working Hours and Compensation

T.P.S. requires all suppliers to comply with all wage and hour laws as mandated by applicable country law or industry standard. T.P.S. also expects that employees will not routinely work in excess of sixty hours per week and employees will be provided with a minimum of one rest day in every seven-day week.

Suppliers must offer vacation time, leave periods, and holidays consistent with applicable laws and regulations.

6. Statutory Social Security and Welfare Benefits

T.P.S. requires that suppliers will contribute to all statutory social security and welfare funds to which employers and/or employees are required by applicable laws to contribute, including medical insurance, industrial injury insurance, pension, housing and unemployment funds, as well as contribute to these funds on behalf of all employees in accordance with all relevant laws and regulations.

HEALTH & SAFETY AND ENVIRONMENT

7. Health and Safety

T.P.S. require that suppliers will provide employees with a safe and healthy workplace in compliance with all applicable laws and regulations, ensuring at a minimum, occupational safety, emergency preparedness, industrial hygiene, reasonable access to potable water and sanitary facilities, fire safety, and adequate lighting and ventilation. Any supplier that is a manufacturer will also ensure that the same standards of health and safety are applied in any housing or canteen facilities that it provides for employees.

8. Environment

T.P.S. expects that suppliers will comply with all applicable environmental laws and regulations and ensure that all required environmental permits and registrations are obtained, maintained and kept current and that operational and reporting requirements are followed.

INTELLECTUAL PROPERTY

9. Anti-Piracy

T.P.S. requires that suppliers will respect all intellectual property rights and will not copy or allow third party access to any T.P.S. or T.P.S. client’s content without authorisation, including but not limited to any form of film, video or digital elements, except as necessary to perform obligations under a supplier’s agreement with T.P.S.

IMPLEMENTATION AND COMPLIANCE

These guidelines highlight T.P.S.’s expectations (and in some cases requirements) of the manner in which its suppliers will conduct themselves in their business relationships with T.P.S.
T.P.S. recognises that achieving the standards established in these guidelines will be a dynamic rather than a static process and encourages suppliers to continually improve their workplace conditions.

T.P.S. expects that suppliers will work with their own suppliers and subcontractors to ensure that they also meet the principles of these guidelines or an equivalent set of principles.

T.P.S. conducts an audit that includes physical inspection, and where possible, background check/s, to ascertain if a new supplier meets the guidelines within this Supplier Code of Conduct, before commencing business with each supplier. A supplier may be given time to comply with these guidelines if they are found to be at least 75% compliant and that it is foreseeable they have the ability to be fully compliant within a short period of time.

T.P.S. conducts continual monitoring of all suppliers to ensure they maintain compliance of the Supplier Code of Conduct.
T.P.S. may visit a supplier’s facility, with or without notice, to assess compliance with this Code.

It is entirely within T.P.S.’s discretion whether to continue to use a supplier.
All suppliers are aware that the failure to consistently meet these standards will impact the future ability to do business with T.P.S., and may at its discretion, decide to cease all business activities as well as reserve the right to take such actions as it deems appropriate.
